Terms and Conditions

These Terms and Conditions govern access to the Gymzol website, demo process, subscriptions, software, support, integrations, and related services.

Gymzol is a software product operated by Grow Matic, a registered business in Pakistan. By accessing or using Gymzol, requesting a demo, starting a trial, or purchasing a service, you agree to these terms.

If you use Gymzol on behalf of a business or organization, you confirm that you have authority to bind that organization.

Gymzol provides gym and facility management capabilities that may include member management, attendance, access control, fees and payment records, leads, bookings, staff, payroll, reporting, analytics, communications, POS, inventory, and integrations.

Features, limits, support levels, hardware compatibility, integrations, setup requirements, and pricing may depend on the selected plan or written proposal.

Customers are responsible for providing accurate account information, maintaining secure credentials, assigning appropriate staff permissions, and all activity performed through their accounts.

Login credentials must not be shared with unauthorized persons. You must notify Gymzol promptly if you suspect unauthorized access, credential compromise, or misuse.

Where offered, Gymzol may provide a free trial lasting three (3) days. Trial availability, included features, setup, and eligibility may be subject to approval and technical requirements.

The website does not currently process online payments and the trial does not automatically charge a payment card through the website. Continued service after the trial requires a separate subscription or commercial agreement.

Gymzol may limit, suspend, or end a trial where it is misused, duplicated, used for unlawful purposes, or creates a security or operational risk.

Subscription, setup, customization, hardware, integration, training, and other charges will be stated in the applicable plan, quotation, invoice, order, or written agreement.

The Gymzol marketing website does not currently accept online payment. Payments agreed with a customer may be collected through separate invoicing or other approved methods.

Customers are responsible for applicable taxes, duties, banking fees, and third-party charges unless expressly stated otherwise.

Eligible 30-day refund requests

A customer may request a full refund within thirty (30) days of payment where Gymzol has failed to provide the purchased service, the service contains a material unresolved defect, or Gymzol is otherwise unable to deliver the agreed service.

Change-of-mind exclusions

The 30-day money-back guarantee does not apply where the request is based solely on a change of mind, or where account access, onboarding, setup, customization, training, integration work, or substantial use of the service has already started.

Cancellation notice

Subscription cancellation requires at least thirty (30) days' prior written notice. Cancellation stops future renewals after the applicable notice period but does not automatically make previous payments refundable.

Refund processing

Approved refunds will be returned through the original or another mutually agreed payment method where reasonably possible. Processing time may depend on the bank or payment provider.

Nothing in this section excludes any mandatory remedy available under applicable law.

Customers retain responsibility for the information they enter, upload, collect, or process through Gymzol. Customers must ensure that they have the necessary authority, notices, permissions, and lawful basis for processing member, visitor, employee, trainer, biometric, attendance, payment, and other operational information.

Customers must maintain accurate records, configure access rights appropriately, and avoid entering information that is unnecessary for their legitimate operations.

You must not use Gymzol to:

• Break any applicable law or third-party rights.
• Gain unauthorized access to accounts, networks, software, or information.
• Introduce malware, harmful code, automated attacks, or disruptive traffic.
• Copy, reverse engineer, resell, sublicense, or exploit Gymzol except where expressly authorized.
• Upload unlawful, fraudulent, infringing, misleading, or harmful content.
• Share accounts or credentials with unauthorized parties.
• Interfere with security, service availability, monitoring, or technical restrictions.

Gymzol may connect with payment providers, email services, WhatsApp, analytics tools, access-control devices, biometric systems, hardware, accounting tools, or other third-party services.

Third-party services are operated independently and may be subject to their own terms, fees, availability, security, support, and privacy practices. Gymzol is not responsible for failures caused solely by a third-party service outside our reasonable control.

We aim to provide a reliable service but do not guarantee uninterrupted or error-free availability. Service may be affected by scheduled maintenance, emergency maintenance, internet or power failures, hosting issues, cyber incidents, customer configuration, third-party systems, or events beyond reasonable control.

We may update features, interfaces, security controls, and technical requirements to improve the service, address risks, or meet operational needs.

Gymzol software, website content, visual design, branding, logos, code, documentation, and related materials are owned by or licensed to Grow Matic and are protected by applicable intellectual-property laws.

A paid subscription grants the customer a limited, non-exclusive, non-transferable right to use Gymzol for authorized internal business operations during the subscription period.

We may restrict or suspend access where payment is overdue, these terms are materially breached, the service is misused, security is threatened, or continued access may create legal or operational risk.

Where reasonably possible, we will provide notice and an opportunity to address the issue. Serious unlawful, fraudulent, or security-related misuse may require immediate action.

Gymzol is provided on an as-available basis, subject to the applicable plan, written commitments, and mandatory legal rights. We do not guarantee that every feature or integration will meet every customer's requirements without configuration or customization.

To the maximum extent permitted by applicable law, Grow Matic will not be liable for indirect, incidental, special, punitive, or consequential loss, loss of profit, loss of opportunity, or loss caused by customer misuse, unauthorized access, inaccurate data, third-party systems, or events outside reasonable control.

Nothing in these terms excludes liability that cannot lawfully be excluded or limited.

These terms are governed by the laws of Pakistan. The parties should first attempt to resolve disputes through good-faith written communication.

Subject to any mandatory rights or forum requirements under applicable law, disputes will be submitted to the competent courts of Karachi, Sindh, Pakistan.

We may update these terms to reflect service, pricing, security, operational, or legal changes. Material changes will apply from the updated effective date or as otherwise communicated.
